Litigation and Civil Disputes

Nobody likes to go to court but unfortunately disputes do happen and sometimes they can't be resolved outside of a courtroom. Despite your best intentions, your contractual partner may breach the contract or may accuse you of having breached it, or there might be a difference of opinion that cannot be resolved between the two parties. You might consider handling the matter yourself and not hiring a lawyer. On the first look, this may save you some lawyer fees but usually that translates into you higher costs in the long term and lowering odds of your winning at the court as you may not be familiar with the details of law or know how best to represent your case. Call us today for a consultation session, and get started before it's too late. Remember the law does not allow you to take action anytime you wish. You have to work within timelines and limitations.

Let us handle the paperwork – you can get back to doing what you love.

Franchise

Franchisor

Are you a new or existing franchisor who like to hand off the legal aspect of running your business to someone else so you could focus on expanding your business and ensure you're compliant with the local laws? After all, just because you might have a franchise agreement that a franchisee has signed doesn't guarantee the enforceability of all its sections if it ever makes it to the Court. Is your franchise agreement or other parts of your process compliant with Franchises Act of Alberta or other jurisdictions in which you operate? Let's have a chat and make sure that your potential growth is not going to get hindered because of an oversight.

Franchisee

Are you thinking about buying into an existing and proven business? Are you thinking why invest all that money in a new and unproven business when you can take advantage of a tried and true business system? Did you know that local laws may or may not obligate franchisors to adhere to a strict body of law to ensure validity of their franchise agreements? Moreover, did you know that if your franchisor has not complied with the local law and regulatory regime, your franchise agreement may be voidable? Or you might be entitled to damages? We recommend you to definitely talk to us before you sign the agreement to understand your rights and your obligations.

Family Law

Uncontested Divorce
This is where either the husband or the wife (called the Plaintiff) files for a divorce with or maybe without the notice of the other spouse (called the Defendant). In addition to filing the Statement of the Claim for divorce at the Court, the Plaintiff needs to ensure that s/he serves the Defendant personally with a copy of the claim. In an uncontested divorce, the Defendant does not respond to the claim and the Plaintiff proceeds. In theory such a process sounds simple and you may decide to take on such endeavour by yourself. However, if you have a trained professional by your side who knows the law and knows about your rights and obligations, especially when emotions are high, is a huge relief and peace of mind.

Joint Divorce

Similar to uncontested divorce, a joint divorce could be a cost and time-effective option for the spouses. In such a scenario, both parties are involved and jointly ask for a divorce from the Court. In joint divorces, both parties are in agreement regarding issues such as division of property and child/spousal support.

Agreements

We agree with the saying that it is better to be safe than sorry. You hope for the best but also prepare for the worst. So, if you need help with drafting a prenuptial agreement or a cohabitation agreement, please get in touch with us and we can help. Also, if you feel that your marriage has run its course, we can assist you with drafting a separation agreement that is agreeable to you and your partner.

Will, Enduring Power of Attorney and Personal Directive

Wills

One of the most important documents you will ever sign is your will – it will never affect you in your lifetime, but it will dictate how your assets are split amongst your loved ones after you die. If you have children who are under the age of 18, it will tell the court who you want to be their guardian; if you have pets, it will tell the court who you want to take care of your pet. Death isn’t a topic anyone wants to talk about, but if we have to talk about it, let’s make sure that you’re as prepared (legally) as you can be. Let us help you protect your assets and provide for your loved ones.

Power of Attorney

A Power of Attorney assists if you’re ever in the position of not being able to handle your own affairs or make your own decisions regarding housing, nursing, and day-to-day activities. It gives someone else the legal rights to manage your affairs, including your bank accounts, and any assets you own. Not a document that anybody ever wants to think about or make, but one that you should have, especially as you age.

Personal Directive

Another difficult document to consider, but also important. If you end up in the hospital and are unable to make decisions regarding your medical welfare due to any variety of reasons, the Personal Directive allows you to appoint someone to be that decision maker on your behalf, as well as note your specific wishes. Another document that nobody wants to consider, but that is really important, if it should even need to be used.

Notarization

Notarization

Sometimes you need a lawyer/Notary public's signature, stamp and seal on a document. This could be for signing a document that specifically asks for the signature to be notarized or maybe you need to notarize a copy of a document for submission as part of an application process. We are just one quick call away.

Commissioner for Oaths

If you need to swear an affidavit or your bank requires you to complete a Statutory Declaration, we can assist you with those as well.
